What is Solicitation of a Minor?
 

Solicitation of a minor for sexual purposes occurs when an adult contacts a person under 16 years old with the intent of engaging in a sexual act with the minor.

  Examples:      
 
  • A 40 year old man uses instant messenger to get a 13 year old girl to meet with him to have sex.

  • An 18 year old boy asks his 15 year old girlfriend to have sex with him.

  Penalties: 
 
  • Up to 4 years in prison and/or $4,000

  • The defendant is charged with solicitation of a minor for immoral purposes. To prove this charge the prosecutor must prove each of the following elements beyond a reasonable doubt:

  • First, the defendant accosted, solicited or enticed a child.

  • Second, the child was under 16 years of age, or the defendant believe the child was under 16 years of age. 

  • Third, the defendant intended to induce or force that child or individual to commit an immoral act, to submit to an act of sexual intercourse or an act of gross indecency, or to any other act of depravity or delinquency.
