What is a Sexually Delinquent Person?
 

A sexually delinquent person is any person whose sexual behavior is characterized by repetitive or compulsive acts which indicate a disregard of consequences or the recognized rights of others, or by the use of force upon another person in attempting sexual relations of either a heterosexual or homosexual nature, or by the commission of sexual aggressions against children under the age of 16.

 

Being sexually delinquent will increase the penalty, up to life in prison, for any sex crimes that a person is charged with. In order to prove a person is sexually delinquent, the prosecution has to have an expert examine the person who is being charged.

 

For example, a first offense of indecent exposure is one year misdemeanor. On a second offense, a person can be charged with being a sexually delinquent person.

What Defenses are there?

  Non exposure: 
    The body part that was claimed to have been exposed was not exposed.
  Lack of knowledge:
    The accused person did not know their body part was exposed. For example, you forgot to zip your fly. Accident: The exposure was unintentional.
  For example:
    A woman's  bikini top comes off in the pool.

Jury Instruction

 

The defendant is charged with the crime of indecent exposure. To prove this charge, the prosecutor must prove each of the following elements beyond a reasonable doubt:

  • First, that the defendant exposed his [state part of body].

  • Second, that the defendant knew that he was exposing his [state part of body].
