What is Reckless Driving?
 

Reckless driving is driving in a way that disregards the safety of other people and property. 

   
  Examples:
 
  • Squealing your tires.

  • Playing “chicken” in your car.

  • Doing donuts in a snowy parking lot, or on a frozen lake

  Penalties:      
 
  • Up to 93 days in jail and/or $500

  • 6 points on driver record

  • $500 driver responsibility fee for two years

  • Up to 90 day license suspension

What Defenses are THERE?

  Lack of intent:
    The prosecution has to prove not just that the perpetrator drove dangerously, but that he drove with "willful and wanton disregard." For example, if someone is driving a Toyota and his gas pedal gets stuck, he's not guilty of reckless driving because the dangerous driving was caused by a malfunction and wasn't intentional.
  Not on a public road:
    A person can only be convicted of Reckless Driving for driving that occurs on a public road or in a public parking lot that opens to a public road. For example, someone burning donuts in a private driveway cannot be convicted of Reckless Driving.

Jury Instruction

 

The defendant is charged with the crime of reckless driving. To prove this charge, the prosecutor must prove each of the following elements beyond a reasonable doubt:

  • First, that the defendant drove a motor vehicle on a highway or other place open to the public [or generally accessible to motor vehicles, including a designated parking area].

  • Second, that the defendant drove the motor vehicle in willful or wanton disregard for the safety of persons or property. "Willful or wanton disregard" means more than simple carelessness but does not require proof of an intent to cause harm. It means knowingly disregarding the possible risks to the safety of people or property.
