Credit card fraud (also known as a financial transaction device crime) is obtaining or using someone else's credit card with the intent to defraud them, or the credit card company.

What Defenses Are There? |

Consent: |

The person whose name is on the card consented to the transaction. For example, a relative lets you borrow their credit card to pay for your car to get fixed.

You used the credit card, but not with the intent to defraud anyone. For example, you used your mom's credit card, but planned on paying her back for what you charged. |

The Defendant is charged with credit card fraud (financial transaction device). To prove this charge, the prosecutor must prove each of the following elements beyond a reasonable doubt:
First, that the defendant obtained possession of, retained, hid, or used the credit card
Second, that the defendant did this knowingly.
Third, that the defendant did this without credit card owner’s consent.

Fourth, that the defendant intended to defraud or cheat someone.
