  People v. Oray (Domestic Violence) 48th District Court Bloomfield Hills
 

In a very ugly family dispute, Henry is given a choice. He must either agree to a divorce under his wife's terms, or sit in jail. Henry chose to go to trial. NOT GUILTY

Henry was charged with domestic violence. Henry was working on a green card although he had been in the U.S.A. for eleven years. He owned a cleaning business with his wife Olga. One day Olga started an affair with one of their employees who was twenty years younger than her. When Henry found out he begged her to stop for the sake of there three year old daughter, but she would not. One night they got in an argument and Henry smashed the computer because she was using it to e-mail her young lover. She swung at Henry in a rage and in the process bruised her arms. Olga called the police and they came and arrested Henry. They would not listen to a word he said. Henry sat in jail for twenty three days because he did not have any of his friend’s home numbers because he did not have his cell phone. While in jail Henry got served with divorce papers offering him $200,000 and his bail if he would sign them and give custody to Olga. Henry was worth over $1,000,000 at the time.

Henry’s court appointed lawyer waived Henry’s right to a jury trial so we had to trust judge Small with Henry’s life. If convicted Henry would be deported.

We were able to use the divorce papers to show the judge just what kind of person Olga was. We used a reenactment of the struggle over the computer to show how Olga could have received her injuries.


The judge found Henry not guilty. This is the only bench trial that I have ever won. Of course it is the only time I have ever had a bench trial..
