Mike had no idea that coming home and protecting himself and his girlfriend from an unknown man would result in a SWAT team visiting his apartment. He was found NOT GUILTY.
Mike was accused of Felonious Assault, Felony Firearm, and Possession of Marijuana. He and his girlfriend had gone to dinner. When they returned to his apartment in Grosse Pointe Parkthere was a car parked out front blocking the sidewalk. Mike and his girlfriend had to walk through a snow bank to get to his door. He called the person in the car an asshole. Mike didn't know that the person in the car was an undercover cop who was staking out the area looking for a burglar.
The cop did not identify himself as an officer and asked Mike if he had a fucking problem. Mike thought this guy might be a robber so he went into his house and came out with his rifle. He showed the cop the rifle to let him know not to mess with him. The next thing you know the streets are blocked off, and they have the SWAT team surrounding Mike's building. When they came in and arrested him they found heroin and marijuana.
During the trial the cop testified that Mike walked halfway between his apartment door and his car and pointed a gun at him. The cop then goes on to tell how he rolled out of his car to take cover and when he looked up Mike was gone. We did a reenactment of this event which proved that it could not have happened like the cop said based on a diagram and photographs from the scene.
I argued to the jury that if he had really pointed the rifle at the cop that Mike's parents would have been attending a funeral not a trial. The jury convicted him of the marijuana possession and acquitted him of the other charges. The judge suppressed the heroin evidence on constitutional grounds.
