  People v. Mayles (Home Invasion, Felony Firearm, Felonious Assault)
 
Rob was facing a two year minimum mandatory sentence and a five to fifteen year prison sentence. After a hung jury, Dan Ambrose was able to secure a probation sentence.

Police Report

 

Rob stood accused of home invasion, felonious assault, and felony firearm. His two accusers, Richardand his prostitute girlfriend Michelle, testified that he drove his truck up to the front door of their home, got out, came barging through the front door with a gun drawn and demanded to know where his girlfriend, A.J., was at. Rob looked around the house and left. Rob lived only three doors down. The police came to Rob’s house and arrested him. They searched his house and found a hand gun.

Our theory was that Mike was trying to get rid of Rob because Rob’s girlfriend was a prostitute that worked for Richard and he wanted her back.
When asked what he did for a living Mike stated he was a “dice dealer.” I asked him where and he said an “out of state casino but he has not worked in five years.” The next day Mike showed up in all satin, a “pimpin” outfit.

Michelle testified she showed up in jail clothes. She was doing time for prostitution. The jury was out for two days. They hung 11-1 in favor of acquittal. Rob pled guilty to attempted felonious assault and got one year of probation. He was facing a mandatory 2 years for the gun and 5-15 for the home invasion.
