(Drunk Driving) 48th District Court Bloomfield Hill

Another case where Trooper Huggins' credibility is destroyed. This time the Judge declares Trooper Huggins testimony to be unreliable, due to his past actions. The breath test was thrown out and Cheryl was able to plea to a civil infraction of Careless Driving!

Sherry was arrested for OUIL. Trooper Huggins performed the breath test and did not write down the time that he started his fifteen minute observation period, which is required before the test. A hearing was held and, as expected, he testified that he did this test correctly although he did not know the time that he started the observation. He testified that he always did the test the same way, the correct way. Well, that was the opening I was waiting for. I showed the court a video tape from another case of a breath test that Huggins did. This video showed Huggins putting the defendant in a jail cell for the fifteen minutes that he was supposed to be observing him, in violation of the Administrative Rules.

The court, over the prosecutor's objection, threw out the test and declared Trooper Huggins a liar. Sherry accepted a plea to Careless Driving, a 3 point Civil Infraction.
