After Fred suffered a fractured orbital and sixty stitches, he and Curt were charged with assault. Both would never be involved if they were not standing up for an abused child. Both were found NOT GUILTY and I also won a civil suit against the same liars.
Malinda picked on Tyler, Fred’s ten year old son, mercilessly. Not only with words but she actually grabbed him and slammed him against a car. Her and her boyfriend, Joe, started picking on Tyler again. This took place in Curt’s driveway, Curt’s son and Tyler were friends. Curt’s house was the one where all the kids played. When Curt heard them picking on Tyler he came out and told Joe to “pick on someone his own size.” At this point Joe challenged Curt to fight. Curt ignored him. Curt’s wife, Debbie, called Fred to let him know what was happening. Fred pulls up in Curt’s driveway and is attacked by Joe. They were rolling around on the ground and Curt eventually got them apart. At some point Joe kicked Fred in the head while Fred was getting off the ground. Fred got sixty stitches and a fractured orbital. The Waterford police were called. The officer took a report, no arrests were made. Joe and Fred were both told that if they want to press charges that they have would have to wait three days and go see the prosecuting attorney for Waterford. When Fred went to see the prosecutor three days later he was informed that both he and Curt were being charged with assault and battery on Joe Ramirez.
There acquittals did not equate to justice in my, Fred’s, and Curt’s eyes. Joe and Malinda needed to be held accountable for what they did to these men. I filed a Malicious Prosecution claim against them in January of 2001. They and their lawyer did everything they could do to delay this case, but they could not avoid their destiny. Finally after four years of delays we got in front of our jury. The jury awarded $37,600 in damages. The judge trebled the award to 123,000
