People v. Baumgartner(Drunk Driving Causing Death)
Jason was charged with operating under the influence of marijuana and alcohol, causing death. The facts looked bad. He had a .08 blood alcohol content and marijuana in his system, and he hit and killed a motorcyclist on D-19 in Livingston County. The trial took three weeks. Click on the video above to see the actual closing argument to the jury. After 5 days of deliberations, the judge declared a mistrial because of a hung jury. Unfortunately, Jason hired a different lawyer for his second trial. He was found Guilty and is still serving time in prison.
In an emotional closing statement, I tell the jury why bias, prejudice, and sympathy need to be left out of the jury deliberations.
