Penalties:
the penalties for willfully and maliciously setting a fire depend on the value of the property destroyed.
Valued at $200 or less—up to 1 year in jail
Valued $1,000 - $20,000—up to 5 years in prison and/or 3 times the value of the property

The defendant is charged with the crime of willfully and maliciously setting a fire. To prove this charge, the prosecutor must prove each of the following elements beyond a reasonable doubt:
First, the defendant set a fire, or helped or persuaded someone else to set a fire or put flammables near a building with the intent to start a fire.
Second, the defendant intended to start a fire or intended to commit an act that created a very high risk of starting a fire, and while committing the act, the defendant knew of that risk and disregarded it.
