WEAPONS IN A MOTOR VECHICLE

What is Weapons in a Motor Vehicle?

 

Carrying a gun, knife, or other dangerous weapon in your car.

 

Examples:

  • Having a gun in your trunk.

  • Keeping a knife in the glove box of your car.

Penalties:

  • Up to 5 years in prison and/or $2,500

What Defenses Are There?

  Hunting knife:
   

A person may carry a hunting knife on his body or in his car.

  Permit:
   

A permit may be obtained for a person to lawfully carry a weapon.

  Weapon inoperable:
   

It is not against the law to carry a firearm that cannot be used.

  Defendant unaware of weapon:
   

The person did not know the weapon was on them.

  Carrying weapon in permitted place:
   

A person can carry a weapon in their home, place of business or land that they own, without obtaining a permit.

  Carrying to place of repair:
   

A person can legally carry a weapon to a place to get it fixed.

  Shooting range:
   

A person can carry a weapon to and from a shooting range, but should always have proof of their destination.

Jury Instruction:

 

The defendant is charged with the crime of carrying a concealed pistol. To prove this charge, the prosecutor must prove each of the following elements beyond a reasonable doubt:

  1. First, that a pistol was in a vehicle that the defendant was in.[*]

  2. Second, that the defendant knew the pistol was there.

  3. Third, that the defendant took part in carrying or keeping the pistol in the vehicle.
