VOLUNTARY MANSLAUGHTER
   

What is Voluntary Manslaughter?

  Voluntary manslaughter is an intentional killing of another in the heat of passion or under provocation.
   
  Penalties:
  • Up to 15 years in prison and/or $7,500

Examples:

Seeing your spouse cheating on you and killing her partner in the heat of the moment.

What defenses are there?

 

Death not caused by Defendant:

   

Someone died, but the Defendant was not the one who is responsible for their death, or they the Defendant did something but that is not what killed the other person.

 

Justification:

   

The Defendant had a legally recognized excuse for the killing, such as self-defense, defense of another person, or accident.

Jury Instruction:

 
  • The defendant is charged with the crime of voluntary manslaughter. To prove this charge, the prosecutor must prove each of the following elements beyond a reasonable doubt:

  • First, that the defendant caused the death of [name deceased], that is, that [name deceased] died as a result of [state alleged act causing death].

  • Second, that the defendant had one of these three states of mind: he intended to kill, or he intended to do great bodily harm to [name deceased], or he knowingly created a very high risk of death or great bodily harm knowing that death or such harm would be the likely result of his actions.

  • Third, that the defendant caused the death without lawful excuse or justification.
