NEGLIGENT HOMICIDE
   

What is Negligent Homicide?

  Negligent homicide is defined as causing the death of a person by driving either carelessly, recklessly, negligently, or at an immoderate speed, but without being "willful or wanton."
   
  Penalties:
  • Up to 2 years in prison and/or $2,000

What Defenses are THERE?

  The Deceased Person's negligence Caused the Accident:
    The prosecutor must prove that the victim's death was caused by the negligent driving of the perpetrator. For example, John is driving 70 miles per hour in a 45 mile per hour zone. If John sideswipes Mary's car when she drives through a red light, he could be innocent of negligent homicide because the accident was actually caused by Mary's driving, even though John was driving at an immoderate speed.

CJI2d 16.12

  • The defendant is charged with the crime of negligent homicide in operating his motor vehicle in such a manner as to cause the death of [name deceased]. To prove this charge, the prosecutor must prove each of the following elements beyond a reasonable doubt:

  • First, that the defendant was operating his motor vehicle on or about [date], at [place].

  • Second, that he operated the vehicle at an immoderate rate of speed or in a careless, reckless, or negligent manner.

  • Third, that the defendant's negligent driving was a substantial cause of an accident resulting in injuries to [name deceased].

  • Fourth, that such injuries caused the death of [name deceased]
