What is Larceny from a Motor Vehicle? |
| |
Larceny from a motor vehicle is stealing a wheel, tire, air bag, radio, stereo, clock, telephone, computer or electronic devices from a vehicle, house trailer, trailer or semi- trailer. |

Penalties:
The penalties for larceny depend on the value of the property stolen:
Value of $20,000 or more: up to 10 years in prison and/or up to $15,000
Value of $1,000-$20,000: up to 5 years in prison and/or up to $10,000
Value of $200-$1,000: up to 1 year in jail and/or $2,000
Value less than $200: up to 93 days in jail and/or $50
If any part of the vehicle is broken, torn or damaged and the value of the property is less than $1,000: up to 5 years in prison and/or $10,000

Jury Instruction: |

The defendant is charged with the crime of larceny from a motor vehicle. To prove this charge, the prosecutor must prove each of the following elements beyond a reasonable doubt:
First, that the defendant took someone else's property.
Second, that the property was taken without consent.
Third, that there was some movement of the property. [It does not matter whether the defendant actually kept the property.]
Fourth, that at the time the property was taken, the defendant intended to permanently deprive the owner of the property.
Fifth, that the property was taken from a motor vehicle, house trailer, trailer or semi-trailer.
Sixth, that the motor vehicle, house trailer, trailer or semi- trailer did not belong to Defendant.
