The defendant is charged with firearm discharged at a dwelling. To prove this charge, the prosecutor must prove each of the following elements beyond a reasonable doubt:
First, the defendant was in possession of a firearm. Second, the defendant intentionally or with reckless conduch discharged the firearm. The discharge was aimed at or in the direction of a dwelling or occupied structure. |
